PREAMBLE
These Terms and Conditions of Sale come into effect on the date they are published online and shall be binding upon the Customer from the first use of the online store on the Site.
These Terms and Conditions remain in effect for the entire duration of use of the online store and until replaced by a new version.
The Seller reserves the right to modify certain provisions of these Terms and Conditions at any time. Such modifications take effect upon publication and do not apply to contracts concluded prior to said modifications.
Any use of the online store following an update to the Terms and Conditions constitutes acceptance of the new version by the Customer.
Each purchase is governed by the Terms and Conditions in effect on the date the order is placed.
By validating their order, the Customer accepts these Terms and Conditions in full and without reservation.
These Terms and Conditions govern the sale of all products, whether purchased individually or together, regardless of quantity.
The Customer declares having read and accepted the following provisions before placing an order.
All products presented on the Site are original creations manufactured individually in France. Product descriptions, including key characteristics such as materials used, specifications, illustrations, and dimensions, are detailed on the Site.
The Customer is responsible for consulting each product's description to understand its essential properties and characteristics.
Product photographs are as accurate as possible but cannot guarantee a perfect match with the actual product received. Color variations may occur due to the technical limitations of screen rendering. The Seller shall not be held liable for minor discrepancies that may arise.
DELIVERY TIMEFRAMES
Delivery time depends on two factors:
- Order preparation time
- Chosen shipping method
The estimated delivery time is displayed when selecting a shipping method, before finalizing the order.
Timeframes are provided as estimates and should not be considered as firm deadlines.
The estimated dispatch date is visible in the customer's account under "Order History" then "Originally Announced Dispatch Date."
Any delay beyond the stated timeframes does not entitle the Customer to financial compensation. Any goodwill gestures remain at the Seller's sole discretion.
Each product listing includes availability information: "Available within 15 business days" — Orders are prepared and dispatched within an average of 15 business days, as each item is assembled by hand by our watchmaker.
Order processing time includes assembly and movement verification.
Chosen shipping method:
The Customer selects their preferred shipping method at checkout from the options available on the Site.
MONDIAL RELAY: Average delivery time is 4 to 10 days after dispatch.
If stock availability does not match what was confirmed, the Customer will be notified by email of the order cancellation.
TRANSFER OF OWNERSHIP
Per Article L 216-2 of the French Consumer Code: "All risk of loss or damage to the goods is transferred to the consumer at the moment when the consumer or a third party designated by them takes physical possession of the goods."
The Customer becomes responsible for received products upon accepting delivery without raising duly qualified reservations regarding packaging.
IMPORTANT: Upon receiving or collecting the order, and before the carrier departs, the Customer must open and inspect the package, verifying both product conformity and quantity.
The Customer will sign a delivery or transport receipt. Any anomalies (damage, non-conformity: wrong product, color, or dimensions; missing items, etc.) must be noted as specific, legible, and detailed reservations on that receipt.
In such cases, the Customer must refuse delivery. They must also confirm their reservations by registered letter with acknowledgment of receipt addressed to the carrier and to the Seller's customer service, specifying the order number, within three (3) business days of delivery. After this period, and absent these formalities, products will be deemed compliant and free of apparent defects.
In the event of confirmed non-conformity, or if the Seller agrees on a commercial basis to accept a return, replacement will be subject to stock availability. Otherwise, the Seller will cancel and refund the unavailable order.
For a delivery accepted as compliant by the Customer but later disputed, the Customer must send customer service a photograph of the product they consider non-compliant.
IMPORTANT: In the absence of reservations, or where reservations are insufficient, the Seller reserves the right to refuse returns, exchanges, or refunds. Once the Customer has signed the delivery receipt without precise reservations, both the carrier and the Seller are released from liability for any damage that may have occurred during delivery. Notes such as "subject to unpacking" have no legal effect and do not exempt the Customer from their duty to inspect delivered products.
If the carrier's personnel do not allow the Customer sufficient time to inspect the product, this must be noted on the transport receipt and countersigned by the carrier's representative. Failing that, the Seller's customer service must be notified as soon as possible.
In accordance with Article L.221-15 of the French Consumer Code, the Seller is not liable for the loss or deterioration of a package where fault lies with the consumer, a case of force majeure, or a third party.
PRICING
All prices are listed in euros, inclusive of all taxes (VAT not applicable per Article 293B of the French General Tax Code). Prices do not include processing fees (shipping, packaging, and preparation, per current applicable rates). Any change in the applicable tax rate may be reflected in product prices.
SHIPPING COSTS
Shipping via MONDIAL RELAY pick-up point is free of charge for France and EU countries.
In the event a package is returned to the sender due to "unclaimed parcel," "refused delivery," "incomplete address," or "recipient not at stated address," the Customer will be responsible for paying new shipping costs to receive their package.
MORIN & CO may provide a photograph of any returned package.
Claims submitted more than 30 days after a non-delivery will not be accepted.
PAYMENT
Orders will not be dispatched until payment has been received in full. Products remain the property of MORIN & CO until complete payment has been made.
In the event of an obvious pricing error, the affected order will be cancelled and refunded as promptly as possible.
Payment methods
Orders can be paid via PayPal, Stripe, or credit/debit card.
RIGHT OF WITHDRAWAL
The consumer may exercise their right of withdrawal from a distance contract as soon as it has been concluded, within a maximum period of fourteen (14) days from receipt of the goods, without having to provide a reason or bear any costs other than the return shipping fees.

CLAIMS
Under Article L. 221-18 of the French Consumer Code, you have 14 days from receipt of the products to exercise your right of withdrawal, without justification or penalties.
For insured packages: if a package arrives open or damaged (including bearing yellow "La Poste" tape), the Customer must immediately file a "spoliation report" (Form 170 for La Poste) so that MORIN & CO can open an investigation and compensation procedure.
The Customer must then send a copy of this report within 14 days by email to morinandco.contact@gmail.com. Any claim received after this deadline will be rejected.
Delivery errors / non-compliant products: The Customer must notify MORIN & CO of any delivery error or product non-conformity within 14 days of delivery. Any claim filed after this deadline will be rejected without possibility of appeal.
To be accepted by our after-sales service, returned products must be: intact (no signs of wear), complete (in perfect resalable condition), in their original packaging, and accompanied by all accessories (straps, links, etc.), user manuals, and warranty card if applicable. If any elements are missing or the product shows irreversible signs of use, the Customer will be notified by email and the return will be refused and sent back to the sender.
Claims submitted outside of the rules and deadlines defined above will not be considered, and MORIN & CO will be released from all liability toward the consumer.
In the case of a partial return, the refund will only be issued if the returned products are in perfect condition, unused, and in their original sealed packaging.
Refunds will only be processed once returned products have been received and inspected at MORIN & CO's registered address (below).
Items returned damaged, incomplete, or soiled will not be accepted. If unclaimed after one week, defective returned merchandise will be automatically destroyed.
If a customer is dissatisfied with the color or quality of a product, return shipping costs are the Customer's responsibility.
WARRANTY
All watch products sold on the Site carry a 1-year warranty covering manufacturing defects, excluding misuse (sport or extreme conditions) and normal wear.
Return shipping is the Customer's responsibility and at their expense. The invoice will be included in the package.

In accordance with the French Data Protection Act No. 78-17 of January 6, 1978, you have the right to access and correct personal data held about you.
To exercise this right, simply submit a request online or by mail, indicating your contact details (last name, first name, address).
MORIN & CO undertakes not to disclose your personal information to third parties. Such information is strictly confidential and will only be used by our sales department to process orders and inform you of new arrivals.

APPLICABLE LAW AND JURISDICTION
Should any clause of these Terms and Conditions be rendered null and void by a change in legislation, regulation, or court decision, this shall in no way affect the validity and enforceability of the remaining provisions.
These Terms and Conditions are governed by French law. In the event of a dispute, the competent court shall be that of the defendant's place of domicile.
